The Organizing Committee of World Intelligence Congress (hereinafter referred to as the “Organizing Committee”) hereby reminds you (hereinafter referred to as the "User") to carefully read and fully understand this Software License and User Service Agreement (hereinafter referred to as this “Agreement”). You shall not have the right to register, log in and use the related service covered by this Agreement unless you accept all the terms of this Agreement. You agree to the terms of this Agreement by registering, logging in and using the service.
Your acceptance of this Agreement will be deemed that you agree to be bound by all the terms of this Agreement, including any amendments made by the Organizing Committee to any terms of service at any time. This Agreement may be updated at any time. Once the terms of the updated agreement are announced, they shall replace the terms of the original agreement without further notice. Users can check the terms of the latest version of the agreement on the relevant service page. If you do not accept the revised terms, please stop using this Service immediately, and the continued use of this Service shall constitute your acceptance of any changes or revisions to the Agreement.
I. Scope of the Applicable Subject of the Agreement
1.1 This Agreement is an agreement signed between and by the User and the Organizing Committee regarding the User's download, installation, use and copying of the software (hereinafter referred to as "this Software") and the use of related service.
1.2 "User" refers to any individual or organization that registers, logs in, uses and browses this Service.
1.3 The content of this Agreement also includes the relevant agreements and business rules about this Service that may be released by the Organizing Committee from time to time. Once the above content is officially released, it is an integral part of this Agreement, and you shall also abide by it.
II. About this Service
2.1 Form of this Service
The client software of this Service provides information products related to the Sixth World Intelligence Congress, including but not limited to related websites, APPs, H5 applets and other online products (hereinafter referred to as "this Software"). The software version must match the terminal device where the software is to be installed.
2.2 Scope permitted by this Service
2.2.1 The Organizing Committee grants you a personal, non-transferable and non-exclusive license to use this Software.
2.2.2 All other rights not expressly authorized by this Article and other terms of this Agreement are still reserved by the Organizing Committee, and to exercise these rights, a separate written approval must be obtained from the Organizing Committee. Failure to exercise any of the foregoing rights shall not constitute a waiver of the same on the Organizing Committee's part.
III. Acquisition of Software
3.1 You can obtain this Software from a third party authorized by the Organizing Committee.
3.2 If you obtain this Software or an installation program with the same name as this Software from a third party that is not authorized by the Organizing Committee, the Organizing Committee cannot guarantee that the software can be used normally, and shall not be responsible for any losses caused to you.
IV. Protection of the User’s Personal Information
4.1 Protecting the User’s personal information is a basic principle of the Organizing Committee, and the Organizing Committee shall take reasonable measures to protect the User’s personal information. Except for situations stipulated by laws and regulations, the Organizing Committee shall not share, transfer, or publicly disclose the User’s personal information to any third party without the permission of the User, unless otherwise stipulated by laws and regulations or otherwise agreed.
4.2 In the process of registering an account or using this Service, you shall provide some necessary information, for example: in order to provide you with account registration services or User identification, you shall fill in your mobile phone number. If there are special regulations in national laws, regulations or policies, you shall provide true identity information. If the information you provide is incomplete, you shall not be able to use this Service or shall be restricted during use.
4.3 The Organizing Committee shall adopt professional encryption storage and transmission methods to ensure the safety of User's personal information.
The Organizing Committee shall use various security technologies and procedures to establish a complete management system to protect your personal information from unauthorized access, use or disclosure.
4.4 The Organizing Committee attaches great importance to the protection of personal information of minors. If you are a minor under the age of 18, you shall obtain the written consent of your parent or legal guardian before using this Service.
V. Major Rights and Obligations
5.1 Account usage specifications
5.1.1 You shall register an account before using this Service.
5.1.2 The ownership of the software account belongs to the Organizing Committee. After the User completes the application registration procedures, the User has only acquired the right to use the account. Such right resides only in the initial account applicant.
5.1.3 The User shall properly keep the registered account information and the account password, and bear legal responsibility thereof. The User agrees not to disclose account and password information to others under any circumstances. When you suspect that someone else is using your account, you shall immediately notify the Organizing Committee.
5.1.4 If the User fails to log in to the account for a long time after registering the software account, the Organizing Committee has the right to reclaim the account to avoid waste of resources, and any loss caused thereby shall be borne by the User.
5.2 User precautions
5.2.1 You understand and agree that in order to provide you with effective services, this Software will use the resources such as processor and bandwidth of your terminal device. During the use of this Software, data traffic costs may be incurred. The User shall obtain information related to traffic fee from the operator and bear the relevant costs.
5.2.2 When you use a particular service of this Software, the service may have separate agreements, relevant business rules, etc. (hereinafter collectively referred to as "Separate Agreements"). Please read and agree to the relevant Separate Agreements before using the service. Your use of the aforementioned specific services is deemed to be your acceptance of the relevant Separate Agreements.
5.2.3 You understand and agree that the Organizing Committee shall use its commercially reasonable efforts to ensure the security of your data storage in this Software and this Service, but the Organizing Committee cannot provide complete guarantees for this, including but not limited to the following situations:
5.2.3.1 The Organizing Committee is not responsible for your failure to delete or store your relevant data in this Software and this Service;
5.2.3.2 The Organizing Committee reserves the right to determine the maximum storage period of a single user's data in this Software and this Service according to the actual situation, and allocate the maximum storage space for the data on the server. You may back up the relevant data in this Software and this Service at your own discretion;
5.2.3.3 If you stop using this Software and this Service or this Service is terminated or cancelled, the Organizing Committee may permanently delete your data from the server. After this Service is stopped, terminated or cancelled, the Organizing Committee has no obligation to return any data to you.
5.2.4 When using this Software and this Service, the User shall bear the following risks that are beyond the control of the Organizing Committee, including but not limited to:
5.2.4.1 Risks such as loss or leakage of personal information that may be caused by irresistible factors;
5.2.4.2 The software version must match the terminal device where the software is to be installed, otherwise, any problem or damage caused by the mismatch shall be borne by the User;
5.2.4.3 When the User uses this Software to visit a third-party website, the risks that may be caused by the third-party website and related content shall be borne by the User;
5.2.4.4 Risks and responsibilities arising from forwarding and sharing contents posted by the User;
5.2.4.5 Risks such as login failure, incomplete data synchronization, and slow page load speed that arise from unstable wireless network signal, low wireless network bandwidth and other reasons.
5.3 Third-party products and services
5.3.1 When you use any products or services provided by a third party of this Software, in addition to complying with the provisions of this Agreement, you shall comply with the third party's user agreement.
5.3.2 When the User uses this Software or requires the Organizing Committee to provide any specific service, this Software may call a system of a third party or support the User's use of or access to the system through the third party. The Organizing Committee shall not guarantee that the service or products provided by a third party is safe, accurate, valid and risk-free. Any disputes and damages caused thereby have nothing to do with the Organizing Committee, and the Organizing Committee shall not bear any responsibility for such disputes and damages.
VI. User Code of Conduct
6.1 Information content specification
6.1.1 You understand and agree that the Organizing Committee has always been committed to providing the User with a civilized, healthy, standardized and orderly network environment. You shall not use this Software account or this Software and this Service to produce, copy, publish, or disseminate the following contents which interfere with the normal operations of the Organizing Committee and infringe upon the legal rights of other users or third parties, including but not limited to:
6.1.1.1 Publishing, transmitting, disseminating or storing any content that violates national laws and regulations:
(1) Violating basic principles established by the Constitution;
(2) Endangering national security, leaking state secrets, subverting state power, and undermining national unity;
(3) Damaging state honor and interests;
(4) Inciting ethnic hatred or ethnic discrimination or undermining ethnic unity;
(5) Undermining national religious policies or advocating any cult or feudal superstition;
(6) Spreading rumors, disrupting social order and social stability;
(7) Spreading obscenity, pornography, gambling, violence, terror, or abetting crimes;
(8) Insulting or defaming others, or infringing on the legal rights and interests of others;
(9) Inciting illegal assemblies, associations, processions, demonstrations, or gathering crowds to disrupt social order;
(10) Organizing or carrying out activity in the name of illegal civil organizations;
(11) Failing to comply with the "seven bottom lines" requirements, including compliance with laws and regulations, the socialist system, national interests, citizens' legitimate interests, public order, social morals and customs, and information authenticity; or
(12) Containing other content prohibited by laws and administrative regulations.
6.1.1.2 Publishing, transmitting, disseminating or storing any content that infringes upon others' legal rights such as reputation rights, portrait rights, intellectual property rights, and trade secrets;
6.1.1.3 Involving others’ privacy, personal information or data;
6.1.1.4 Publishing, transmitting or disseminating harassment, advertising information, excessive marketing information and spam, or containing any sex or sexual hints; or
6.1.1.5 Other information that violates laws, regulations, policies, public order and good customs, and social ethics, or interferes with the normal operations of the Organizing Committee and infringes on the legitimate rights and interests of other users or third parties.
6.2 Being responsible for your actions
You fully understand and agree that you must be responsible for all actions under your registered account, including any content you post and any consequences arising therefrom. You shall make your own judgment on the content of this Service and assume all risks arising from the use of the content, including the risks arising from the reliance on the correctness, completeness or practicality of the content. The Organizing Committee cannot and shall not be liable for any loss or damage caused by the aforementioned risks.
6.3 Handling of violations
6.3.1 If the Organizing Committee finds or receives reports or complaints from others that the User violated this Agreement, the Organizing Committee has the right to delete and block relevant content at any time without notice, and depending on the circumstances, impose disciplinary measures, including but not limited to warnings, restriction or prohibition of using some or all of the functions, account bans and cancellations for violating accounts, and announce the results of the processing.
6.3.2 You understand and agree that the Organizing Committee has the right to impose disciplinary measures for any violations of relevant laws and regulations or the provisions of this Agreement based on reasonable judgments, take appropriate legal actions against any users who violate laws and regulations, and save relevant information in accordance with laws and regulations to report to relevant departments, and the User shall solely bear all legal responsibilities arising therefrom.
6.3.3 You understand and agree that you shall be solely responsible for any claims or demands made by or losses incurred to a third party due to your violation of the provisions of this Agreement or related terms of service; you shall also be responsible for any losses caused thereby to the Organizing Committee.
VII. Intellectual Property Statement
7.1 The Organizing Committee is the owner of the intellectual property rights of this Software. All copyrights, trademark rights, patent rights, trade secrets and other intellectual property rights of this Software, as well as all information content related to this Software (including but not limited to texts, pictures, audio, video, graphics, interface design, layout framework, related data or electronic documents) are protected by the laws and regulations of the People’s Republic of China and corresponding international treaties. The Organizing Committee shall be entitled to the above intellectual property rights, except for those rights to which the relevant rights holders shall be entitled in accordance with the law.
7.2 Without the written consent of the Organizing Committee or relevant right holders, you shall not (and shall not permit any third party) to implement, use, or transfer the above intellectual property rights for any commercial or non-commercial purposes.
VIII. Terminal Security Responsibility
8.1 You understand and agree that this software, like most Internet software, may be affected by a variety of factors, including but not limited to user reasons, network service quality and social environment; it may also be affected by various security issues, including but not limited to illegal use of user information by others to carry out actual harassment; other software downloaded and installed by the User or other websites visited by the User may contain viruses, Trojan horse programs or other malicious programs, which threaten your terminal device information and data security, and then affect the normal use of this Software. Therefore, you shall strengthen the awareness of information security and personal information protection, and pay attention to password protection to avoid losses.
8.2 You shall not produce, publish, use, or disseminate malicious programs used to steal this Software account and others’ personal information and property.
8.3 Maintaining the security and normal use of the software is the joint responsibility of the Organizing Committee and you. The Organizing Committee shall reasonably and prudently take necessary technical measures to protect your terminal equipment information and data security in accordance with industry standards, but you shall acknowledge and agree that the Organizing Committee cannot provide a complete guarantee for it.
8.4 In any case, you shall not be gullible about borrowing money, asking for passwords or other network information involving property. In the case of property operations, please verify the identity of the other party first, and always pay attention to the tips on preventing fraud and crime.
IX. Miscellaneous
9.1 The Organizing Committee solemnly reminds the User to pay attention to the clauses in this Agreement that exempt the Organizing Committee from responsibilities and increase obligations of the User. The User is requested to read them carefully and consider risks independently.
9.2 If any provision of this Agreement is determined to be invalid or unenforceable, whether in part or in whole, it shall not affect the enforceability of any other provision of this Agreement.
9.3 This Agreement shall take effect from the date you agree to it and are successfully registered as a user of this Software. Unless the Organizing Committee terminates this Agreement or you lose your user qualifications, this Agreement shall remain valid. The termination of this Agreement does not exempt the User from his/her obligations and responsibilities under this Agreement or other relevant agreements and rules.
9.4 The headings of all clauses of this Agreement are for reading convenience only, and they have no actual meaning and cannot be used as the basis for interpretation of the meaning of this Agreement.
9.5 The Agreement was signed in Binhai New District, Tianjin. The interpretation, validity and dispute settlement of this Agreement shall be governed by the laws of the Mainland China (excluding conflict of laws). Any dispute or controversy arising between the User and the Organizing Committee shall first be settled through friendly negotiation; if the negotiation fails, you shall agree to submit the dispute or controversy to the people's court with jurisdiction in the place where this Agreement is signed.
